Bill Cosby received some bad news in his criminal sex assault case. The disgraced former "The Cosby Show" star's confessions he made in a 2006 civil suit will be allowed during trial. The comedian's attorneys attempted to have the confession suppressed, but the motion was denied.

Cosby's lawyers made the point that the actor only confessed because he was told he would not be prosecuted. Cosby settled that civit suit for an undisclosed amount of money.

On Monday, Montgomery Country Judge Steven O'Neill stated the promise was not in writing. In O'Neill's ruling he stated, "This court concludes that there was neither an agreement nor a promise not to prosecute, only an exercise of prosecutorial discretion."


Cosby, 79, admitted in the 2006 deposition that he had a string of extramarital relationships with young women. He referred to those encounters as consensual, but many of the women claim they were drugged before being sexually assaulted.

The release of the deposition testimony last year prompted prosecutors to reopen previous criminal complaints. This includes the 2004 incident with Andrea Constand, who is one of the complainants in the current criminal case.

Cosby gave Constand three blue pills when she said she was feeling stressed, which left her nearly unconscious. Cosby then allegedly sexually assaulted her. 
During the deposition, Cosby stated, "I don't hear her say anything. And I don't feel her say anything. And so I go into the area that is somewhere between permission and rejection. I am not stopped."

In a different part of the testimony, Cosby brought up a a phone call with Constand's mother a year after the incident. He stated, "I'm not going to argue with somebody's mother who is accusing me of something. And I'm apologising because I'm thinking this is a dirty old man with a young girl. I apologised. I said to the mother, it was digital penetration."

Cosby also admitted obtaining prescriptions for Quaaludes, which he kept to give women he hoped to have sex with. Cosby described it as "the same as a person would say, 'Have a drink.'"

The decision to include the testimony is one part of the key issues for the trial. The other decision will include how many accusers will be allowed to testify.




Prosecutors are hoping that all 13 additional women will be able to testify. There will be a decision on the number of witnesses allowed next week. 

Cosby's lawyers will most likely argue the point that some of the women's accounts are decades old and rather vague. Cosby is also reportedly legally blind and can no longer recognize his accusers.
