Jennifer Hudson and ex-fiancé David Otunga are heading to court over their bitter child custody case next year. 

According to court documents obtained by The Blast, an Illinois judge set the start of the trial for December 11, where The Voice judge will face off with the WWE Superstar over custody of their 9-year-old son. 

Over the course of 5 days, they both will testify in court and argue their respective cases for who deserves more custody and who should be the one to pay child support.

This comes just over a year after Hudson filed for a restraining order against Otunga after ending their 10-year relationship. She claimed he exhibited "aggressive, threatening and harassing behavior" toward her.

The court granted the temporary request but Hudson would later drop the petition altogether. Otunga has always denied the allegations.

Hudson and Otunga got engaged in 2008 and welcomed their son a year later.

You have likely already heard that Jennifer Hudson and her ex-fiancé David are done.

Oh and the custody battle over their son has been even more of a disaster, it seems.

As David was recently cleared of domestic violence charges, J-Hud’s police report has now been released.

TMZ has the scoop. 

According to the publication, the singer extraordinaire told officers that she and David were bickering over where their son, David Jr., would sleep that night. 

She said they had been arguing earlier in the evening because he was upset that David Jr. was at a recording studio with her and a music producer who David claimed was her new boyfriend and the guy David believed she cheated on him with.
The music producer, whose real name is Kortney Jamaal Pollard, is a singer, songwriter, and producer. Mali Music was a gospel artist but later crossed over into secular music. Hudson referred to him as her "dream artist."

Jennifer claims that David said, “Don’t have my son around your [expletive] boyfriend,” adding he would come to the studio to “[expletive] him up.”

Jennifer (who denies the producer was her boyfriend, by the way) insisted that, during the fight, David picked up their son, said “I’m not leaving” and took David Jr. upstairs to a bathroom. 

She followed and he supposedly pushed her with both hands to shove her out of the room. She claims she stumbled backward and yelled for her security guard. The guard says he never heard her call for him.

David has denied laying a hand on her. He even made the media rounds, much to Jennifer’s presumed annoyance.

The police report also pointed to an incident in April 2017, in which Jennifer claims she went into their kitchen to find David sitting next to a gun and staring ominously at her, though she concedes he told her it was a toy gun and removed it from the house.

Jennifer received a restraining order the day after the bathroom incident, forcing David out of the family home. She has since dropped the restraining order and they have come to a temporary custody agreement.

After Jennifer announced the separation, David’s attorney, Tracy Rizzo, stated, "David Otunga has been trying to negotiate the terms of an amicable parenting agreement with Ms. Hudson for several weeks now. However, when it became apparent to Ms. Hudson that Mr. Otunga would be the parent granted residential care of the child, as a result of Mr. Otunga being the child’s primary caregiver while Ms. Hudson pursues her career all over the world."

"Ms. Hudson decided to file a merit-less Petition for Order of Protection in an effort to gain an unfair advantage in the custody dispute. As a result of Mr. Otunga’s career in the WWE, Ms. Hudson felt that she could give an award winning performance in court to portray herself as the victim.  Mr. Otunga has never abused or harassed Ms. Hudson or their son.”
